RTI - Private Recognised State Govt School

Dear Forum members,

We filed an application on RTI to local DEO about a school which is runnning from PAST 20 yrs. We got reply from the PIO that the school has temporary registration and the copy enclosed, the said PIO asked to contact local MEO for more information, and also forwarded our RTI application to the school(for which we are seeking information) stating  the school managment to give the information to us and mark a copy to DEO office.

But unfortunately in the reply letter we did not receive the said enclosed copy(temporary registration). Immediately we wrote an application to PIO about the missing enclosure(the said enclosed copy of temporary registration) in the disposal of the application, the next 3rd day we also sent a RTI application to MEO for information about the school.

Now it is more than 35 days, but we did not receive any communication from the PIO of DEO/MEO/School Management

My Questions?

•What to do next, shoud we go for FAA? any better suggestions from the Ld. Members

•The best possible way to get informtaion from PIO of Board of Secondary Education/Director of School Education/DEO about...  the Do/Donts (crieteria,basis,procedure,rules,regulation)  for a Private school to get state recognition (getting recognition) from the Government Body.

Pleas enlighten us on the above same.

You     should    file         an     APPEAL     before     the     First      Appellate    Authority     in        the   prescribed     Format     as    per    the    RTI  Act, 2005.

It  is the duty of PIO to procure the information from the institution/subordinate office and to provide the information applied for, rather than redirecting applicant to the subordinate. In your case it amounts to failure of duty on the part of  DEO and it will be appropriate  to file an appeal, as suggested by our frineds here.-All the best.

AS FAR AS I UNDERSTAND THE PIO PROVIDE YOU THE INFORMATION WITHIN 30 DAYS TO YOU.  & ALSO NOTED THAT

SECTION 19 OF THE RTI ACT 2005, SAYS THAT “a person who does not receive a decision within the specified time limit of 30 days may make a request for appeal. In case a person is aggrieved or dissatisfied with the decision of public information officer make an appeal within 30 days to such officer who is senior in rank to public information officer.”

AS PER YOU, 35 DAYS ALREADY LAPSED, THEREFORE YOU ARE NOT ELIGIBLE FOR FIRST APPEAL AS PER  THE RTI ACT, 2005. SECTION 19(1) , RTI ACT, 2005

File a fresh application before Tamilnadu secondary education board directorate seeking the specific information what you need ,  if the PIO is not responding within 30 days , You can file 1st apeal under section 

19(1) of the RTI Act or directly complaint to State information commission under Section 18 of the RTI Act
