RTI Information Commissioner (IC) issues warrant to PIO

Under RTI Act, the Information commissioner is empowered to issue  warrants to secure the presence of the PIO, as is evident from the latest order of the IC (nagpur).

Mumbai: In a first of its kind case, Nagpur information commissioner Vilas Patil had issued a warrant against a senior inspector of police after he failed to appear before the commission.


 

   “Despite several notices, when the inspector failed to turn up, we invoked the provisions of the Civil Procedure Code. Then a notice was served on him, stating that if he fails to turn up, a
bailable warrant will be issued against him. While the commission was in the process of issuing a warrant, the inspector presented himself before the commission,’’ a senior official said.

 


   The case in which the senior inspector was summoned pertains to a complaint of theft of ornaments lodged with a police station in Nagpur.

 


   When there was no progress in the investigation and no response from senior police officials, the complainant filed an application under the Right to Information Act to know about the status of the probe. However, there was no response to his right to information application too. He then filed an appeal before the Nagpur bench of the information commission.

 


   As per the provisions of the RTI Act, Patil issued a notice to the police inspector. Then he was asked to present his case before the commission.

 


   Despite several notices and reminders, when the inspector failed to appear before the commission, Patil invoked provisions of the Civil Procedure Code. Then the Nagpur information commissioner issued a notice, saying that if the senior inspector fails to appear before the commission, then a warrant will be issued in his name. “The inspector immediately appeared before the commission and submitted his plea,’’ he said.

 


   On the provisions of the Civil Procedure Code, the official said if attendance of a person is essential in a particular case and if he is not cooperating, then the competent authority has powers to issue a bailable and nonbailable warrant against that person.


 

  Under the RTI Act, the commissioner has powers to invoke the provisions of the Civil Procedure Code. Of course, for the first time, these provisions were invoked to ensure presence of the police inspector,’’ he said.

This is a fitting lesson every one of the PIOs in the country as thr essence of RTI Act is very catehorical in so fas as penal clause is concerned This specific order has now vecome a model and an important and it is hoped that in a somilar fashion

It is an example set by Mr. Vilas Patil, State Information Commissioner (Nagpur Zone).

 

It is the actual and appropriate action for which every Information Commissioner has been assigned at a higher price of package of Rs.1,00,000/- per month with other emoluments and facilities.

 

But unfortunately other side the State Chief Information Commissioner Mr. (Dr.) Suresh Vinayak Joshi is found as a worst information commissioner and more bad thing is that he has become THE CHIEF in Maharashtra Information Commission.  I am having lots of evidence of his insolvancy & incapability for this post.  He is ex. Metropolitan Commissioner of MMRDA and when the post of SCIC was to fill up he resigned from Government service since the public servant cannot be appointed as Information Commissioner, and he took over as State Chief Information Commossioner from back door by using his political connections and since he himself is a bureaucrat and so he is doing nothing in the appeals submitted against public servants since they are his colleagues.

 

It is now more than a 60 years passed away after 26 January 1950 when the Democratic Constitution was adopted with a system of “RULE OF PEOPLE-RULE BY PEOPLE-RULE FOR PEOPLE”… But the RULE not given in the hands of people and BUREAUCRATS (both in Executive and Judiciary) and POLITICIANS (who are using it like a professional business) taken the COMMAND in their hands.  The majority of people are illiterate and these diplomats (Bureaucrats & Politicians) ever try to keep them illiterate & poor so that they will be ever busy in struggle for life and never become aware of their RIGHT TO RULE.  Till now every action of these diplomats is being kept far away from the people so that the people do not know what they do???

Now, the Right To Information of people is protected by the ACT existed as “RIGHT TO INFORMATION ACT 2005”.  But we have to exercise it properly since these diplomats will never let it be used effectively.

 

The people of Democratic India ever have the Right To Information as a part of their Democratic Rights.  But, the Bureaucrats have broken it under a false shelter of Official Secret Act 1923 which was actually gone died on 26 January 1950.  Therefore, now the RTI Act 2005 come into existence to penalize the public servants who deny information to any citizen within time frame and for its mean every citizen can have all the information within their individual capacity whatever the information a Legislative Assembly or Parliament can call.  BUT IT IS VERY UNFORTUNATE AS EVER THAT THE BUREAUCRACY WILL NEVER LET IT TO BE EFFECTIVE AND BUREAUCRATS ARE EVERYWHERE INCLUDING JUDICIARY. 

 

It is the BUREAUCRACY which has no implementation of DEMOCRACY

Only the British Bureaucrats gone and their illegal generation captured the power.  They are thrown out since they could be thrown out but these are comparatively multiple times dangerous since these are "BHED KI KHAAL ME BHEDIYA".  DICTATORS in the dress code of "PUBLIC SERVANTS".  It is the need to continuously "JAAGTE RAHO !!!!!!!......." which unfortunately people did not understand for more than 60 years after 26 January 1950 when our ever great Vishwa Vandaniya Param Pujya Dr. Babasaheb Ambedkar succeeded to lead the democratic constitution for us.  What? if our father gave us a FORT but we do not even paint it & save it from thieves?? Our Fort of Democracy is captured by the servants and the PRINCE CITIZEN are crying out of the Gate of his Fort.  So ! Kaisi AAZAADI ??? Aur Kaahe ka LOKTANTRA???  Parliament ever passes proposals but it is the Enemies of Democracy who do not implement it on ground......

 

Visioner of 21st Century late Mr. Rajiv Gandhi said, when he was the Prime Minister with a record majority of MPs, that out of every 100 rupees sanctioned by the Government only 15 rupees reaching to ground and 85 rupees reaching in the pocket of public servants & agents.  Count it, how much money is gone in these 60 years?????  Who will ask?? And can the mishandled money be recovered??? it is whose money???  Every beggar who is begging in this country is only because that his money is looted by this way???????  From where all kinds of injustice happens ?????  Catch them and pull them with tighten their hand before the Court of law of our Democratic Nation and trial them under the sections of RASHTRADROH and through them behind the walls of Jail and recover all the money from them by auction of their property ! YES !! We started to do it.  And we are succeeding in successful steps...  We welcome every citizen in this YAGNA to give AAHUTI of their part......

Exemplary Orders Will other State Infomation Commissioners follow these type of decisions through out the country anf the Nodal Ministry of Government of India needs to issue stringent directions to all the State Governments for implementation of act in perspective and transparent manner

RTI Act 2005 has already been slow poisoned to death by Mr Wahjid Habibulla , its first CIC ,a Bura Cat. We the people of India need to fight against the systemic failures of our bureaucracy as whole . Unless we do that and debureaucratise the Info Commission at all level RTI will die a premature death faster that we think.

Lets spare the politician bashing for the moment and fight against the Bureaucracy. IAS.COM be disbanned from India.

RTI PIO fined by CIC for Delay


A classic "Decision" of the "CENTRAL INFORMATION COMMISSION",  imposing fine for "deliberate delay in providing information"  on an officer of Municipal Corporation of Delhi (MCD), for derelection of duty by a PIO.


This decision  SHOULD be quoted on all 2nd appeal to the CIC and the SIC,  when the PIO fails to provide information (whether incomplete or false or part or whatever) to the RTI applicant.
