RTI IN A False 498A CASE ASKING FOR DETAILS, SO THAT THE CONDUCT OF THE POLICE CAN BE SCUTINAZED , SLAPPED BACK WITH SECTION 8.1.H.

Various RTI asking for details in a 498A case put under Section 5 Life and Liberty were rejected by the PIO on basis of the response from the associated Mahilla Thana by simply putting that the case is under investigation and the i formation imparted will put adverse effect on the case.
The interesting fact here is that the FIR was registered without proper counselling and without proper investigation on the claims of the wife putting forward her false claims and charges, the accused husband has proofs that he was not even in the town when he is being accused of causing cruelity and dowry demands.
The police has not taken note of the facts and has REGISTERED the FIR only as the Father in law has some political and beaurocratic contacts.
He may be personally having aquentences with the Commissioner who ordered to file the FIR to mahilla thana on request of the Father in law.
More interesting fact is that the in laws went to launch the FIR to the commissioners office and have not contacted the local Police Station of their residence which is hardly 3mins away from the residence and claim that the husband who was 500 kms away from Jaipur has made dowry demands and has caused physical cruelty on some random date, but if that was the case then why did they not took the shelter of police station that is 3mins away but waited for many days and later reported the matter to Commissioner and got the FIR under his orders.


The facts could have been u covered by the good draft that was found on this web site but it was slapped back with RTI SECTION 8.1.H.

NOW , an appeal has been registered against the rejection of information as the reply never gave any details on how the imparting of the i formation will jeopardize the case.

As you have already states that First Appeal under RTI is already presented to First Appellate authority let’s wait for it.

Positively you will find all your answers after second appeal.
