Public trust

I am trustee of a Public Charitable trust in Haryana Registered under the Societies Registration Act. Pl inform      a) Whether such a trust is a legal entity which can sue and be sued in its name. b) Whether all trustees have to implead themselves in a suit for eviction of tenant under the Rent Control Act. or can delegate it to two or three trustees.  c) Whether in  a suit prefered against the trust all trustees have to be impleaded. d) Whether a suit can be brought against a trustee for any act of ommission or commission during his working as a Trustee.

yes dear

yes trust is a legal entity and can sue and can be sued in the court.

nope its not compulsory to all trutee to impledge for suit for eviction,they can authorize anyone of them by giving special power

yes a suit pleaded gainst trust means its suit against all trustees but depends upon the by laws of the trust if all powers reside in only one person or trustee then he is liable for that

yes trustee can be sued anytime when the matter came to light whether he is trustee or not in case of any omission he commiteed during his tenure
