Respected Sir,
We have two brothers & one sister. My father has died on 2011; my mother has passed away on 24th Dec 2014. Our parents did not distribute the property & they are died without a Will. We have an ancestor’s house in Kestopur, Kolkata. We have a paddy land around 3 bighas in Murshidabad, to the name of my mother. We have some FDs in bank and ornament of my mother. My elder sister demand she need Bank FDs, ornament (My mother’s), paddy land of Murshidabad. She declared her never asking for house sharing.
An advocate advice us that you can mutually agreement with a stamp paper registered by a notary public as our condition.
My question is:
The agreement is valid? Will my elder sister claim in our ancestor house in future? Is gift deed & agreement is same?
