Property fraud but civil case

Hi. My friend has fradulently transferred a parental property to his name and sold his family property to another member of family through a Benama. Now the family has filed a civil suit against my friend and the purchaser. Now my question is will my friend go to jail for fraud? The family is not willing to put him in jail therefore a civil suit for was filed for amending the property card and cancellation of Benama. Can a civil judge order civil imprisonment for my friend in this case?

Cancellation of the deed is seem to have been proposed. No question fo criminal offence here.

But my friend has given false statement to the Registrar (property card officer) to transfer the property in his name. Can this officer file a criminal case against my friend? I dont think he can. What do you suggest?
