no.  It is onloy a legal right if (i) there is vacancy (ii) he qualifying service as per RR of higher post (iii) he has reuisite grading in ACR (iv) he is senior most (for non-selection post)or stands better than other persons in the consideration zone in case of selection post (v) he is not under the ban of disciplinary case or current penalyt or not undr suspension (vi) he has not refused promotion during lat two years. (vii) he has the requisite qualification, if any prescribed in RR (ix) in case of SC/ST he has a claim for reserved vacancy and he is in the extended zone, if not the senior most.
