Pls guide I am having a writ under 254 of Orissa Municipality Act where the Municipal commissioner or executive officer is having the power to evict road side encroachment. But Please guide what process municipality should follow to know wheather encroachement is there or not. process of measurement of land ,notice etc.
In my case apealant says nobody has visited for demarcation even the notice issued by municipality does says anything regading quantum of encroachment.while asked RTi they hav e submitted one list of encroachers where my client name is written but quantum of encroachemnt and other details vanish.
Pls suggest with citation and judgments.
