Power of attorney

Hi,

"The Principal wants to file a complaint against accused named M/S. B & Co., in the competent court of law and for this purpose he empowers his attorney to file, verify and sign the complaint to be filed u/s 138 of N I Act, to engage counsel for this purpose, to sign any other document, application, to give statement, to file affidavit on behalf of the Principal for the competent court of law".

This is main Para of Power of attorney executed by principal in the name of holder on Rs.500/- stamp paper and duly attested.

But the holder files 4 different complaints on same accused on behalf of same complainant (Principal), by using the same POA in every complaint and signed the each complaint on behalf of his same principal.

Court took cognizance and issued the process in each case (Being complaint was neither signed by complainant or by valid POA )

Pl guide me , how that accused can take the benefit of above mistake held.
