Plot will

Hi All,

My fther has pushaced a plot on my mother names in 1965, and in the same plot he constrcuted a house. Electricty bills and panchayat tax recipets are in my father name, but only the plot is regiatred in my mothers name.

Based on this, does the propety belongs to my father or Mother?, and does my mother can write a will to share the property?

Please let me know.

Thanks & Regards,

Mallik

Since the property is registered in the name of your mother, only she can execute the WILL.

YES , YOUR MOTHER HAD THE ABSOLUTE RIGHT ON THAT PROPERTY,  YOUR MOTHER CAN EXECUTE THE WILL. AS SHE WISH..

if you can prove in the court that your mother has not self earned the property, but acquired as it was purchased by your father and by his money.. she can not will the property .. in other word she can only will a self earned or acquired property.

you can challenge the will in the court of law easily .
