Panchnama

Can the police enter the office of a businessman and take away the books and documents from his offaice, without either making a Panchnama and merely on pin pointing the documents by the complainant? In this particular case, the suit is filed as a private case and not a police case. What will be the recourse if the accused has informed the court of this happening and has also written to the Supt of Police and also the concerned police station. And further can a clerical staff of the police station (usually call the writer) can conduct the said search and take away the said documents?

If it is a private case, the search might have been ordered by the Court.  But the documents seized in the search should be described in the search list and the owner of the office made to sign in it and a copy given to him.

The so called writer in the police station is also a police officer who does the clerical works there. If he is authorised for search he can conduct the same.

You can very well inform this matter in writing to his superior officers and also inform the court. The result of it will be based on their internal enquiry of the facts.
