Occupancy certificate

Hi,

I have purchased a flat in an apartment with plan of 16 flats approved by CMC (Muncipal Council) in Bangalore. Now builder has built 2 extra flats in Ground Floor comromising car parking space. He is not giving us Occupancy certificate. My flat is in 3rd floor. In this case can I get Occupancy Certificate (OC)? What will happen if we don't get and occupy because in Bangalore most of the flats don't have OC and haven't heard of those buildings troubled for that reason? But wanted clarity as I was anxious due to an issue with one of the  apartments. Will be grateful to get some advice.

Mr. Bharath,

This is the right of purchaser to get the OC from your builder.  If your builder did not provide the OC, than you can made representation to the CMC, Land and building department, Urban Development about your grivance.  You can also file a consumer complaint as the builder constructed 2 extra flats also reported to CMC they can demolish the flats as per their approval plan.
