Non occupancy charges

Dear Sir, I have a 25mtrs house in Mhada cluster in malvani malad Mumbai. My Soceity has charged me Rs. 7000/- as non occupancy charges for the year. Our monthly maintenance bill comes to Rs. 600/- per month. Ours is a CHS Ltd society. Is this legal? They have even given me a paper signed by the committee stating the minutes passed in the last agm stating Rs. 7000 as Noc charges for non occupancy. Is all this legal. Please help.

Yes it is...if passed by majority of the committee

But then what about the high court and Supreme Court judgement about 10% of service charges for non occupancy charges . How can a managing commitee contradict.
