Karunanidhi and family, is a sky and mud below difference, though crime is by both sides.  SC to be unbiased in advising CVC/CAG/CBI Authorities, as it is high time the Centre orders, as the same being biased since DMK being a part of UPA- the centre. Media reports Ex.CM Karuna having amassed wealth over thousands of crores in rupees, during the last regime of 5 years, which is most dis-heartening to note. Ex.CJI of the Apex Court was not also willing to shift responsibility, to having supreme courts functioning in State highcourts, while that be the case, why the Case of present CM be continued to be conducted in Bangalore,” Incurring heavy expenditure and extra security bandobust measures for her being in the Z category.  Is there any valid legal reason for the same, to incur heavily considerin national economy, while judiciary is autonomous?  

Courts be sacred, be unbiased, view and understand truth, to give justice. All courts within the state be governed by the High Courts and ultimately by the apex court, watch genuine cases in other states, where injustice caused be under observation by i.e. "Supreme Court of India" Courts should be sensitive to the litigants practical grievances, for giving true justice e.g. O.S.341/2004. I have been wrongly made a party in the family partition suit * just because this ex-serviceman purchaser not being a local while the other 30 land plot purchasers have been left out, of the 32 plot layout formed in 1983. By which, I have been harassed and humiliated attending court from Chennai to Bangalore and back. The young miscreants of the vendor's family after 21 long years, who took law into their hands by encroaching my fenced land by encroaching and pulling out the stone-pillars and the connected barbed wires and black-mailing me. Instead of punishing for their crimes they are encouraged. Where is the justice in this country, as there is no watchdog for court operations. Please help for a viable solution to ensure fair justice to all.

The Supreme Court Judgment cannot abrogate the Right to Life. E.G. A Person "X" has a dying wife "W' and X has no money to save her. He purchased Property "P" through power of attorney and can sell the property through Power of Attorney to save his wife "W". Supreme Court cannot abrogate the right to life of "W" if "X" sells his property 'P'.  Secondly "X" can execute an Indemnity Bond or any other such instrument in favor of "Y" and convert "P" into a Benami property and sell it to  "Y". Supreme Court cannot interfere in Human Rights issues as India is a Signatory to the Universal Declaration of Human Rights[UDHR] and the International Covenant on Civil and Political Rights[ICCPR]. Supreme Court cannot over rule International Covenants to which India is a Signatory. Likewise say if someone wants to go to the VATICAN CITY but has no money except by way of selling his/her property. Supreme Court cannot abrogate religious freedoms by restricting sale of his/her property through power of Attorney/vica versa. In short Supreme Court cannot exceed the powers confered on it by the Constitution. Sooner of later real estate prices might fall and most private holdings might become Benami.

For all practical purposes Karunanidhi is above law.  He was in the CM seat for 5 years.  It was at that time (if i am right) the Koodankulam nucler power project has started and he was keeping his mouth shut  and now he says that Centre and State should intervene and do justice to the peope there.  Where was he during these times  and when he can direct the Central Govt. to resolve the issues otherwise he will put out from the Ministry.  Has he done?  He will not do.  Now he is camping for his daughter's release and may be next time for his daughter"s son "Aditya" a plump ministerial berth .  We will also be happy with that.

Welcome honourable sirs:

I am amazed how closely related American and Indian Constitution are.  There are some areas (cultural) like chaste and title that an American will not understand but we have simular legal issues, ie, corruption of judges, fraud upon the court, etc that we share.

 

I welcome the opportunity to learn more of the insights in Indian Juris Purdence.

By the way, I am not an attorney but a legal scholar
