Need guidance

Respected lawers, My mother's property in Hyderabad was affected under Road widening but the compensation was not given stating that the clearance from the Ceiling Dept had not received by the Municipal corporation of Hyderabad. She took a stay orders from High court when the govt.tried to occupy without giving compensation in the year 2014. Now she is no more in this world. We are 4 brothers and 2 sisters. Out of them 3 brothers stay abroad(Foreign Nationals).we are muslim. My question is How to proceed to claim, secondly do we require any succession certificate, thirdly can we ask to pay the compensation (i.e.rent) for using our land since the demolition in 2014 as kacha road as it can't be used by us. Further, can we ask permission to construct the boundry over our acquired property area. Hamdani

Sir first of all you must go for taking legal representative on record
if your brother is out of India you can arrange there signed Vakalatnama for your Advocate or u can make them respondent
there after you move relevant application for other relief

Contact the HC advocate engaged by your grandmother and take his guidance in impleading you as legal heirs/successors as he is well versed with facts of the entire case.

if the compensation for acquiring land under Land Acquisition Act, 1894, has not been paid to the landowner or deposited with the competent court and the same was retained in the government treasury, then it (land acquisition) would be treated as having lapsed and would be covered under the new 2013 land acquisition law entitling landowners a higher compensation.

You have already engaged an able, competent and intelligent lawyer, seek his/ her guidance for proper proceeding without expecting any special miracle from obligation of experts on this platform.

If you feel storng it is advisable to consult another local prudent lawyer for better appreciation of facts, guidance and proceeding.
