Need Urgent Legal Assistance.

I have about 4 acres of agriculture lands in Karnataka and I am residing a little far away from it. Because it is very far away from where I stay and work , my visit to that place is on yearly once or twice basis. A portion of 1acres 20 guntas was acquired by the Deputy Commissioner for grant of House plot for weaker section of soceity and we had no objection to it because we were served notice and intimated by the DC office. Grants and right certificates were issued to various beneficiaries with regards to the above acquisition.

Of late it has come to my knowledge that the Panchayat Development Officer and Executive Officer of Panchayat Office have colluded and issued additional rights certificates( more than sanctioned limit) and have made arrangements for issue of E-khathas to villagers in the balance 2 acres 20 guntas of lands which is not acquired officially and also we were not served any notice or intimation . The balance lands are not officially acquired by any government agency and nor by Deputy Commissioner. Based on the above , alleged rights certificates "Hakku Patra" were issued illegally by PDO and e khatha made later on ,some villagers have even constructed pukka houses on it....Can the legal team please guide what is proper legal steps I have to take immediately to protect my balance property.

In the absence of due process the action is unlawful. You can approach the High Court in a writer petition or file a civil suit. In the latter case you need to serve a section 80 notice or seek exemption on the ground of urgency.

First, file RTI Application and collect all the evidence.

Information solicited:

1)Please provide me each and every document as a certified copy that was in process of acquiring 2Ac.20Guntas of land owned by.................at..........village, for issuing Hakku Patras by PDO.

2. Please provide me all orders/notifications/circulars issued by Government stating the due process of acquiring such land for House Plots for weaker sections of society as per law.
