Dear Sir/madam,
The case has been referred to me for my views, but since i have no any practise knowledge about this field category so i want your suggestion in this regard, the accused has been arrested under 29-61-85 ND&PS act, he is under the Judicial custody since September 2015 and his Bail was rejected in the session court, the advocate in this case wanted to apply to high court for bail, but he says the chances of getting bail is 50:50. the charge sheet has just come and now the lawyer says we can go for trail without applying for bail since the drugs are not found in the accused possession at the time of arrest, and chances of acquittal are more. my question to all, can we apply for bail in session court with new ground and how long will it take for the case over. the case is in himachal pradesh.
