In Consortium / Multiple financing, the borrowing compnay / lending bank has seek consent for creating charge on property on pari-passu basis. But it is general experience that banks too much time to give such permission. I understand that there is RBI directive that banks must convey decision maximum within three months. But I could not get specific circular from RBI website. May someone give me such reference? I hope the circular may be clarifying as to remedies if banks do not adhere to the instructions given vide such circular. If there is no such reference, I would be happy to know about the remedies available to NOC seeker for delay despite such instrucitons from RBI.
