My land is usarp(hadapna)

mera naam ashish kumar hai mere naana ne marte waqt faridabad me meri mom ke naam ek land kar diya tha ..but jaise hi mere nana ki death hu ( he belongs to sc catagory) hamare gao ka ek aadmi (jo ki general catogory ) ne case kar diya ke mere naana ne usse 50000 hajar rupe udhar liye they aur uske paass ek affidavit bhi jispe mere nana ke sign hai but mujhe mere mama se pata chala ki yeh sab verbaly hua tha aur naana ne paise wapas kar diye they without any reciept , ab usne wo jamin hadapne ke liye lower court me case kiya tha aur wo jeet gaya hai ab humne high court me case kiya hai me yeh jaanna chahta hu ki kya hum is ground par kuch kar sakte hai ki yeh jamin harijan ki hai aur wo general catagory ka hai jamin ki keemat 1 crore hai aur wo haryana me hai.

Is ground par ki yeh jamin Harijan ka hai--  aap Scheduled Castes and Sceduled Tribes ( Prevention of Atrocities) Act, 1989 ki dhara,i.e., Section 3(1) ( V ), and 155  ke antragat bahhoot kooch kar sakte hain.

Phir aapke liye Sceduled Caste and Sceduled Tribe ( Prevention of Atrocities) Rules, 1995 bhi kargar hoga jiske anushar special Police officer ki niyukti hoti hai aise atyacharo ka anushandhan kar ushe rokne ke liye.

Act 1989 Section 3 (1) (V) reads: Whoever not being a member of a Sceduled Caste or Sceduled Tribe ....Wrongfully dispossesses a member of a Sceduled Caste or Sceduled Tribe from his land or premises or interferes with the enjoyment of his rights over any land, premises or water ... shall be punishable with imprisonment for a term which shall not be less than six months but which may extend to five years and with fine.

Section 155 supposes positive and defacto possession of the land as unless  a man is shown to be in actual physical possession of the property, he cannot be dispossessed.
