Marriage certificate after child

Dear All,

My name is Vikash and I am Hindu by birth and my Wife is a Christian by birth. We get married in Church on 11th May 2013 and we have a 2 month old son.

From Last one years, we are trying to get a marriage certificate, but initially lack of Mumbai Address documents, It was not going thru.

 

Now, we have all the documents, but Marriage registrar is not accepting my application under Special Marriage Act.

There logic is that, I am a Hindu so I have to go for Hindu marriage, and convert your wife to Hindu. Which I don’t want.

 

Secondly, I contacted couple of lawyers from Bandra court and they are ready to give me back date marriage certificate under Catholic law. But they demanding very huge amount. Believe me, you won’t even dream of this amount.

 

I am living aboard since 2014, and I need a dependent Visa for my wife and Son.

And as per dependent Visa rule, they need my marriage certificate.

 

Is it okay, if we get married again under special marriage act? Or court marriage with current date?

Is it any problem of having a baby before getting marriage certificate? I have church certificate of marriage.

 

Please suggest, I can’t afford to pay such a huge bribe.

I guess you can get married under special marriage act again. I am not a legal advisor. Check with your immigration team and a legal professional.

Also if needed be prepared to explain the scenario in a vivid manner, we had to get married again and I am not interested in giving bribe to officers.

The consulate should accept it.

Also please have your Sons birth certificate where you and your wife are been as Mother and Father of the Child. Photographs of the Marriage.

All this should help. Wish you Good Luck...Every Problem has a Solution and we just have to figure it out.

you can register the marriage under christian marriage act where it is not necessary that both the parties must be christians
