Maintenance

Can wife demand maintenance when she left the husband on her own will.

Husband used to take care of her and children previously and after her leaving the home, Husband made several efforts for her return...... But, she is unwilling.......

In the name of herself and children, can she claim maintenace and on what Grounds

It is your version that "She left the house on her own will"

but it is obvious that she will blalme you for the sepration in court. You have not mentioned in which section your maintenance case is pending but in all the sections court has the power to  grant interim maintenance.

So you have to pay the maintenance to wife and Ofcourse you are legally bound to pay maintenance to your children.

How to address such difficult situation? If day to day adjustment, conflicts are finally tackled by wife like this, it is sad.....

The Husband made frantic efforts to get back the wife and children. But, her relatives are simply not in mood for any peaceful reconcillation.

 

How can this maintenance claim be contested........

If she is only a house wife you are bound to pay  monthly interim maintenance to her and to your children.

Yes, wife can claim maintenance for herself and her children. Her right is unfettered. Consult a lawyer with all details.
