Limitation Period

Hi I have a question regarding Limitation Period

My Father had won a  eviction case and later on the tenant went to appeal in High court.. My Father had died in 1994 but the High court dismissed the case in 1997 ... Me and My Mother were having a case with our uncles on legal representative of of Father which we  got in our  judgement in our favor in 1998 .... Now in 2010 we came to know that in 1997 the high court dismissed the petition . Can we evict the tenant based on High court order 1997  in 2010 ???? does the limitation period has any effect on this ????? Please do help

Yes.  You can, but give a prior notice to the tenenant for eviction.

File execution petition for eviction and obtain order of delivery of possession of property.

if even the tenant not evicting the property, file application for police protection and break open
