Legal hier certificate

Hi,

I am putting in Punjab.

My father expired in month of June, i need to apply for Legal Hier certificate, as my mother needs to have gratuaty and Commutation from the State Govt.

Please help me in this.

For this you have to obtain Succession Cert.from the Court.

Can you pls guide me the whole process,

shd i go to any court and ask them to provide me this certificate and what all documents i need to collect and normally how much will it take to get it done.?

File a P & Sc petition to get the succession certificate.  You will have to file a petition.  Meet your lawyer he will do it.

If your father was employed in state govt/central govt office, you may approach the Revenue Dept (Tahsildar) for a legal heir certificate allong with proof of employment, family members record in the office and death certificate.

 

Otherwise file a petition for succession certificate through your advocate.

V. VASUDEVAN (LEGAL COUNSEL)     02 November 2011

A Legal Heir Certificate issued by the local revenue authorities would be sufficient for gratuity and commutation benefits. Succession certificate would be required if immoveable property has to be transferred.
