Legal heir certificate help required

Hello People

As I am having dispute with my father for property after death of my mother. Property is still in her name and my father wants to sell it and dont want to give me anything.

I want to obtain legal heir certificate. Should I hire a lawyer to obtain this certificate or I will get it myself?

What is the procedure for getting it?

Mam,

 

First of all he cannot sell the same, yes you need to claim your share from the court and seek injuction as well so that in the mean time your father should not sell of the property.

I think you need to seek partition of the property claiming your share.

You will be needing a lawyer because it will be little techincal somehow to deal with this sitaution.

if she had died intestate and the property was on her name then you and your father have equal shares in the property.you can apply for a legal heir certificate from tahsildars office and you can do it on your own.if your father refuses to part your share then you can file a partition suit
