Land tribunal

high court of karnataka has passed an order directing Land tribunal of district to register a land in question in the possession of petitioners without mentioning CHECKBANDI. but the possession of land is with defendants from 1945 till date, now my question is can land tribunal 1)can issue From No.10 in petitoners name without having possesion till date?

                            2) can issue Form No.10 without receiving checkbandi from Highcourt?  thanks in advance
