Kids playing and making noise in apartment corridor

Sir pls tell me how can we stop kids playing n making noise in apartment corridor. We r registered under spciety act 1960 of karnataka but few MCembers n residents are not cooprating with others and allowing kids to scream n play . We have by laws which they are not obeying and telling it is not registered so we will not follow. So what to do to stop playing kids in apartment corridor. Thanks

Mirnal ji you may be kid at some time. Think of your self playing at that time and some body stop you from playing that time then how could you feel.

Please try & understand kids play not amount to any kind of disturbance.

Do not look each and every thing by eyes of law, try to look it by common man points of view.

You can approach apartment association , if it does not solve the issue then you can send legal notic or file police complaint.

As per the Indian Govt Apartment owenership act ,

 "Each apartment owner may use the common areas and facilities in accordance with the purpose for which they are intended without hindering or encroaching upon the lawful rights of the other apartment owners. "

As per the above law, corridor is not meant for children's play.

I want to know that since many time two individual from the society yelling on kids saying that children's cant play  at play area after 10. Yester one incident went where kids are playing that guy yelled on them and due to that sudden scream my daughter fell down from the slide and crying and shivering a lot. Kindly help us in this matter what can we do
Our society has 140 flats rest 138 flat members has no issue but this 2 flates mates are constantly doing the ssme thing

1. Friendly Approach:

Talk to the Parents: If you haven't already, try a friendly approach. Talk directly to the parents of the children involved. Explain the inconvenience caused by the noise and suggest alternative play areas.

Committee Intervention: Involve your apartment's Managing Committee (MC) members. The committee can politely remind residents about the bylaws and suggest designated play areas if available.

2. Reinforce Bylaws:

Review Bylaws: Carefully examine your apartment's bylaws registered under the Karnataka Societies Act, 1960. Look for specific clauses regarding noise restrictions or limitations on using common areas like corridors for playing.

Communicate Bylaws: If the bylaws clearly outline noise restrictions or limitations on playing in corridors, the MC can create a formal notice reminding residents of these rules. Post it in common areas for visibility.

3. Address Non-Compliance:

MC Meeting: If residents continue to disregard the bylaws, convene a meeting of the Managing Committee. Document the discussion and any decisions taken.

Formal Warning: The MC can then issue a formal warning letter to non-compliant residents, referencing the specific bylaws being violated and the potential consequences of continued disregard.

4. Legal Route (Last Resort):

Legal Consultation: If the situation remains unresolved, consider consulting a lawyer specializing in society disputes. They can advise on the legal enforceability of your bylaws and the possibility of further action.

Important Points:

Non-Registered Bylaws: While some residents might claim the bylaws aren't enforceable because they aren't registered, bylaws adopted by a properly constituted managing committee are generally considered binding on residents

Physical Measures:

Signage: Put up signs or notices in the corridor reminding residents and children about the rules.

Physical Barriers: Install physical barriers (such as gates or railings) to prevent children from playing in the corridor.

Alternative Play Areas: If feasible, explore creating designated play areas within the complex for children. This can be a compromise that addresses both concerns - allowing children to play freely while minimizing noise disruptions in corridors.

Remember, maintaining a peaceful and cooperative environment in your apartment complex is essential. Following these steps can help you find a solution that works for everyone.
