These days sometimes it appears that orders are issued instead of judgments. Some orders are so absurd that one tends to get an impression as if the orders have been procured by some means.

When non adhering to the basic principles and virtues is the order of the day, what more can be expected? High Courts will also see the examples of Supreme Court. Supreme Court on one hand rightly gives wider meaning to the fundamental rights including Article 20(3) of the Constitution but on other hand when confronted with Section 14 of the Central Excise Act 1944 and Section 108 of the Customs Act, 1962, it chickens out and gives a restricted meaning to Article 20(3). When Supreme Court is behaving in a lame and inconsistent fashion even when things are crystal clear, what can be expected from High Courts?
