my father made an agreement with one Ramesh koshal for sale of property. After some time Ramesh when to Canada and died their. My father had no knowledge of his death for several years and when he came to know about his death my father send legal notice to his legal representative for performance of their part what they denied. now my father have filled a suit against them and they have raised objection that the suit is time barred. is their any authority in support of our case

As a promisor and promise are essential to a contract, so are the time and place of the performance of contract. If a time and place for the performance of the contract are agreed upon, then the promisor should perform the promise accordingly. If not, then it should be performed at a reasonable place and time.
