Is partner voilating any law?

Hi All,

We are about to start an LLP firm. My partner is currently doing job in another firm which deals into same industry of business and he doesn't want to quit his current job.

Should I ignore this or should I not add him as a partner into this business.

If he is add, shall he be violating an law?

Is mine, his or our firm's future will be in jeopardy?

What should we do in this situation?

Please suggest.

The issues raised by you are practical and circumstantial queries, which will have answer while you introspect the entire matter once again.  Decide as per the prevailing situations and issues,there is no legal solution for such day to day affairs nor this is a legal query..

Yes your partner can land in problems -

1.) does his employment condition allow him to do any other business.

2.) He is an interested party so can be sued.

A  partner in LLP can be a sdirector or partner in another LLP. at the same time. There is no bar as such unless any clause in your prtnership deed prohibits him joining  another LLP.
