Installation of Mobile Tower 39 Mmber say Yes and One members says No

We have recd Rs 4 Lakh offer for installation of aircel mobile tower at my house? what commercial terms to be set for mutual benefit ?

There is also objection from one Neighbour stating that the rays are harmful, but we have other 2 near by bldgs , who have installed same mobile tower of Vodafone and BPL, 

Should society can go by majority and install the same, Out of 40 Members , 39 says yes and one says No ?

Cooperative Housing Society, defines the activities that can be carried out in the Society premises (ONLY if conveyance of society premises is done).  Commercial earning by way of installing a Mobile phone Tower, is certainly not amongst them.


Even if ALL  the society members agree to the issue, then too the commercial mobile tower cannot be installed on the society building premises, since it will violate the provisions of the socities Act.  Even an outsider will be able to file a case for violation of the laws of the land.


Even if one member objects, then the above should not be done, in a coop hsg. society. There can be more than half a dozen different cases filed under different Acts on the above matter in different courts and the society will be embroiled in several court cases.


A commercial structure (or say a non commercial structure like a coop. hsg. society building) can install the mobile tower after taking due permission for the Civic authorities and the Fire brigade authorites and the police authorities.

The tower can cause great health risks up to 500 feet around the tower. To install or not depend on you and your neighbours that is around the tower. Why drag the entire society?

We need clear guidelines for installation of mobile towers.

The present rate of payment for installation of tower is very less comparing to other european countries etc.

There are no clear guidelines regarding installation of cell towers in India.  However, the government of India can take action against the tower companies if the members of the colony make a complaint and get the tower removed from that colony.
