Incomplete PHd (doctorate)

Hi Every one....

Need ure guidance and help.

My dad went for Phd programme some 20 years back and signed a bond with the college.

Due to Some issues he couldnt complete the programme and came back . According to bond after completion of the programe you have to serve the college for 3 years. he has been there for last 35 years .

But the question is one of his colleauge who was quite instrumental in making sure tat he didnt get the phd degree, became principal of the college and has written on my dad file tat he need to return the money wat he got tat time with intrest before he retires.

My Dad is retiring this month and now this issue has come up.

1.Do we need to pay back the college?

2.There is no mention in the bond that if you dont complete the degree, tat you have to return the amount.

3. Is there any such law under UGC...?

4.Is the principal of the college has such authority to decide on such issues , since the college is a govt college and run by UGC (central govt).?

5. Can we prosicute this guy for causing such mentral trauma?

It is not clear as to what money you are speaking about? What was the payment about ? Was a Phd a condition for placement in a scale like Lecutrer, lecturer in sr.grade or professor or reader's grade ? Was he paid scale conditionally on the basis of the undertaking ? These conditions are part of UGC upgradation programmes and if that is the case, he may face a problem in his retirement papers, if his service records are stamped by Jt.DE, inclusive of the said condition. Normally, the access payments of such kinds are re covered from the amount of graduity due and admissible, or an undetaking in this behalf has to be atteched to pension papers. This opinion is based on partial information available, ile in service.

Another understanding that is available from your letter is that your dad must have gone on paid leave forPhd under UGC scheme, where anoher person must have been appointed by the institution whose salary was born by the state govt  Phd has to be completed within two years extendable by one year, under the scheme or entire salary grant rlease by UGC to your dad is recoverable.
