A person filed a case of 138 NI Act to recover money from a person and simultaneously filed an FIR for cheating. 138 NI Act case got acquitted due to different and contradictory stories of complainant. Can the same be used to get accused discharged in section 420 IPC case pertaining to the same amount?

Both sections are diffrent but the transaction was same so you can use the same evidence. However you have to appoint good advocate for fighting out case.
