Husband property

SIR,

THERE IS LOT OF CONFUSION AND NO ONE IS CLEAR.

WHAT WILL BE CONSIDERED AS HUSBAND PROPERTY (in which 50% share can be claimed) AS PER NEW AMENDMENT OF MARRIAGE LAW (if passed).

WILL IT BE

1.   PROPERTY IN THE NAME OF HUSBAND

2.PROPERTY IN NAME OF PARENTS

3. PROPERTY RECEIVED FROM GRANDPARENTS (ansisteral property) STILL IN NAME OF PARENTS

Nobody can say in what form the bill will be passed, if it is passed. There may or may not be changes in the existing draft and no body can predict that. There is no point in just speculating, so wait and watch till the amendment is passed.

Not sure, but wife gets 50% in residential properties and rest judge is given powers to decide the alimony considering the merits of the case However after the lok Sabha passes the bill, clarity will emerge

For guys that are planning to file for divorce what precautions can be taken if such law is passed in future?

@Gautam, move into a rented house with your wife then, sell your owned property or gift it to your trusted relative.

Do  so only if you are sure that there is no scope of reconciliation or MCD.
