We have 17 building housing complex at pune,consisting 4 bldg.1BHK+14commercial shops,6 bldg. having 3 BHK flats and 7 bldg.having 2BHK flats.Builder has collected Rs.15000/- Rs.25000/- and Rs.35000/-per year from 1BHK,2BHK,and 3BHK flat owners resp.for the maintenance of the complex and maintained the complex last two year i.e.April'2014 to March'2016.Builder got executed the sale agreement from each one of us to form the Apartment owner's Association under Maharashtra Apartment owner's association act 1970 while handing over the complex likely in the month of April'2016.Majority of flatowners prefer to form co-operative housing society for the complex.In the above circumstance ,Is it legally possible to form co-op.Hsg.society?
Further,the 1BHK and 2BHK flat owners are insisting to collect maintenance amount as above ratio slab,but 3BHK flat owners are opposing it and insisting to collect all common maintenance equal ratio with number of flat irespective of area of flat.Please guide us what is the legal provision for the above two queries.
