Please enlighten me about the possibility of challenging the validity of Kerala hindu joint family abolition act 1975 which came into force from 1-12-1976.

hi sirs,

i  have  a doubt. that  is, as per  KERALA ABKARI ACT if a person is found  transporting  indian made foreign liquior , of another state, in a jeep, normally the procedure to be adopted my the police is to arrest the accused, charging him  u/s 55[a] of kerala abkari act and the property  and jeep will be confiscated to the government u/s 67 of abkari act and a seperate proceedings will be held before the excise commissioner, for the release of the vehicle.

but here the police erred in ,not informing the matter to the excise commissioner, by  preparing an inventory list.

if so, whether, the accused can file a petition u/s 457 crpc before the magistrate court, for the release of the vehicle ?

Dear Learned Friends,

I am a  Lawyer  Practising in Perinthalmanna Courts on Civil side. Until now, I am finding difficulties to share my  views  with other friends in Kerala.  Thanks to the forum. Some of the matters like abolition of  Joint Family Abolition Act etc. are of very much concered  we. Keralites. It is high time to think how to overcome this wrong act. This has become a blow on us over and above the existing  non friendly attitude to  encourage to invest in Kerala.

Hello Sirs,

     Good day! Actually, I am from a different field. But i had some doubts regarding some legal issues in real estate field. I am working for a real estate web portal based in Kochi and we have a blog. A client had asked a couple of legal questions related to real estate on the blog, so i was thinking if any one here could help. I posted about it in some other forum too, but did'nt get a reply there(might be the forums was not based in kerala). So i was hoping, if anyone could here can give proper suggestions since i too am in Kerala. Now the 2 questions which client asked:-

1) I recently paid of a loan in a service corporative bank. I wanted the documents back and along with it there was something called ozhimuri adharam which i had to get. I am not in India and I dont know how to get it. Consulted someone back home and he has told me it will cost me Rs.8000 . My understanding was it should be some Rs.2000. He is talking about some tax that needs to be paid to the government and all… I dont understand. What is ur openion?

2) I am planning to buy a villa from one of the builder in Kottayam. What all taxes will be applicable including registration cost. Please give in %.

These were the 2 questions, any suggestions? I would appreciate if  anyone can give an openion.

i think joint family abolition's constitutionality discussed in AIR 1979 Ker181/ 1979(4) SCC782

Dear Sujith,

I have the information that the Hon' Supreme court has upheld the constitutional validity of the Hindu joint family abolition Act 1975. But I think it was upheld ,because of the fact that it was placed in Schedule IX of the constitution making it free from the challenge before courts. But I think Hon' Supreme court has deviated from its previous stand and held that even the laws placed in Sch IX can be challenged and the courts can decide its constitutionality etc. I raised the above querry mainly to know the views of the Hon' members of this forum. i wish to know whether the law can again be challenged.

it is an interesting aspect, thank u.

certainly we can challenge the same in the new circumstances

if u a good client and he has aggrieved with the Act.

But remember that in DPSP of our constitution discourage the accumulation of wealth in few hands and the Act intended to prevent the perpetuity of Zamindary system. then there will be lot of resistance u face....
