Gst and flat maintenance charges

Dear Sir,   I have purchased underconstruction property in 2015 before GST and Paid full amount.  In  April 2017 I have registered the documents and paid MVAT on agreement value of the property.  Now got possesstion notice from builder with payment of taxes.  They charged ST 4.5%.

As per agreement they are collection maintenance of 2 years @ rs. 3000/- per month and charging GST on the same.  Also they are collecting municipal property tax, MSEB deposit, Deveopment charges, Infrastructure charges, water deposit  and charging GST on the Same. 

Please guide.

It is apparent from the details that GST is not applicable in your case. However it will be prudent to consult a lawyer, with all relevant details, in your own interests.

All those owners should form as a group, pool some amount, and elect a representative to get the facts confirmed through Chartered Accountant and tax authorities.  Only if the dispute is not clarified by the builder to your satisfaction then contact an advocate for further remedy.  The issues to be referred to CA for confirmation are

1. What are the actual charges to be payable by owners as per agreements,

2.Whether builder has charged over and above stipulated norms and collecting from builders,

3. Then issuing him a notice listing the unjustified amount and depending on the response to proceed further.
