Dear Team,

I work in IT industry and got an opportunity to go for abraod for about a year. I filed divorce in counter she filed 498a and DVC against me and family members. Divorce and DVC are at evidence stage. In 498a she has to appear and give her statement but she has not been coming for more than a year. what is the best way for me to go abroad without letting any of my family members affected

If she doesn't come despite the court issuing summons a couple of times, then the court can drop her testimony.

You may with assistance of a good advocate can appeal before court under section 182 IPC or under section 211 Indian Penal Code by the police on the grounds that her complaint/ case against you is false and frivolous.
