General PoA, Tamil Nadu, Irrevocable?

Hi,

Is a registered general PoA executed for a property in the state of Tamil Nadu irrevocable? If no, then how can we make it irrevocable? if yes, then what are the procedures to revoke the PoA ?

Also, if the PoA is irrevocable, under what circumstances can it stand cancelled or void?

Many thanks in advance for your advise.

Best regards,

LB

Dear LB Generally POAs will contain a clause/term about revocability (stated either as REVOCABLE OR IRREVOCABLE). One can make the POA irrevocable by stating in the terms of POA that it is irrevocable. Procedure to revoke: If the POA in your case states that it is revocable then the principal can revoke the POA by giving a notice of revocation to the agent. Circumstances to cancel an irreovable POA: An irrevocable POA can be cancelled/gets void if the agent acts beyond the powers conferred under the POA. Also if the POA is shown to have been obtained/executed by means of fraud or coercion or deceit or misrepresentation by the agent then the POA (irrevocable or revocable) shall be deemed as null and void and can be cancelled by the principal. Does this apply to other states like Maharashtra?
