Fraudulent loan taken on xerox papers

Hello everyone, Kindly advise.... One of my friend got trapped in the situation Few days before one agent came to my friend and took xerox copies of aadhar and other documents for the purpose of obtaining Credit card.. After few months he realize under his name someone has taken loan with opened bank account in bank.. He went to Police station.. But police refuse to take any Complaint.. Kindly advise what is civil and criminal action can be taken and against whom?? As he don't remember that Agent name or his face ??? Thanks in advance..

TELL THE BANK or issue a nortice to  te bank TO MAKE YOUR  ACOUNT INACTIVE  D TILL YOU INSTRUCT  THE BANK TO MAKE IT ACTIvE AGAIN. MEANSWHILE GIVE A POLICE COMPALINT UNDER 420 ipc FOR CHEATING BY ANONYMOUS PESONN AND FIND OUT HIS details  And NAB HIM And prosecute and punish him according tolaw.If you appreciate this answer please conveymy forum thanks..

Any one is supposed to verify the orignal and compare and get the same signed in their presence.

If some one used a xerox, it is the other person who has a duty to verify and was trapped has to proceed.  In the case, the Bank should file complaint.  As the matter has come to the attention of your friend, your friend must deny any transactions with the bank in writing by Regd post and should clearly tell that he is not connected in any way with that transaction.  He may also inform that he has tried to lodge police complaint in...........station at............on.............but complaint was not accepted.  (Infact now lodging police complaint is not a problem as it can be sent by post or on line)

Any one can get xerox copy of AADHAR as the card holder may be submitting to several other places for identity.  He need not remember all such names.

The lesson to be learned is when you give a xerox write on face of it to whom it was given, the purpose and the date on which it is given.

Where was that agent from. This is a fraud. Kindly don't forget to give a written complaint to nearest police station and lodge an FIR or atleast an NC. With that NC inform all your banks as well as RBI nodal officer about the same.

If it is a real problem then:

Submit a complaint by email to SHO,Police Commissioner, BM, Cirtcle head, Chairman of the bank, by email, and followed by letter under proper acknowledgment.

Request to supply you authenticated copies of Loan application, loan agreement, loan a/c statement,KYC docs collected, report of Bank's official for marking OSV, physical verification wit copy to CEPD-RBI,etc etc and close the a/c with a copy to you, in next 3 days.

Also ask the Bank to provide you CCTV footage of the day borrower visited the bank and not to delete it, in next 3 days.

Request police to help you to get it,in next 3 days.

If they do  not act pursue thry RTI and handover the matter to your own counsel and move court.

You can also involve media.

Your friend has not acted properly.  He does not even know the name ofthe agent to whom he gave xerox copies and signed applications. Against whom he will complain?  Has he given his photo also duly signed tothe agent?

 

Please advise your friend to report the entire episode to the Head Office of the bank where loan was alleged to have been taken giving full details.Bank will internally conduct enquiry and find out the position.  If no reply is coming, you may advise your friend to complain to Banking Ombudsman C/O RBI Regional Office concerned.
