Fir withdrawal

Dear Experts,

please could you guide me? my worst half will file an application to take back the FIR u/s 323 and 341 next week as agreed and put in Mutual Consent Divorce Peitition. I had got summons for appearing in the court and i attended the court in october 2014 however judge was on leave. My second date is in Feb end. my first motion got completed two weeks back. please advise if i need to hire an advocate for the same or simply i need to be present when she submits the application for taking FIR back. she will be accompanied by her advocate

Thanks for your advise. please could you also advise what may happen on the day when we both are present and she submits the applicaiotn for FIR withdrawal.

1. will judge close this matter on the basis of her application; or

2. will judge post it for future date for consideration; or

3. is there a need to go into some agreement.
