This is my first post in this forum.
My NRI wife and I are currently separated due to her deciding that we are incompatible. She had filed for "no fault" divorce from USA in 2008. Upon examining the records, I found out that the special marriage act registration initiated by her in Pune did not confirm to the mandatory 30 day notice of intended marriage as required by Indian law.
Does this amount to fraud and automatically nullify the marriage since the same certificate was used by her for other purposes to facilitate her advancement and immigration. I have remained a silent spectator all this while and taken all physical and mental abuse in my stride due to the fact that I have children with her.
