Eviction details

Our tenant started delaying payments immediately after occupying the house on rent. He started aggregating the rent and payed it together in our bank acct once in 2 or 3 months when ever he felt like. if asked they replied saying atleast we are paying it right. This kept happening for more than a year. He always had one or other family excuses. He kept doing that and So we told them we need the house and we gave him a oral 3 months rental  termination notice. They agreed but after 3 months again he started giving excuses. Not only excuses but he started using bad words.This kept happening 4- 5 months. He hasn't payed the rent. all these 5 months. Finally we asked him to sign up a return termination notice saying that he will leave the house which he said he wont. We just wanted him to leave. So we told him we will waive all the rent. But we are in need of the house.

he promised to leave the house this month and on the day he called up and said he need a week more to finsh all his house work. So we thought we will wait till he gives the keys.

But today , we heard from the police station that he has filed a complaint against us saying we have threatened him whch for sure we didnt do.

Even after his not paying rent every month We havent been very polite and did not do anything to send eviction notice.

This is what we get for having allowed him and being lenient. and even waiving the rent.

Unfortunately somehow we dont have the rental agreement signed by him .But we have everyone else before his.

We never had this kind of problem before with any other tenants.


What should we do now?

In addition to the details he and his family is saying that we received the rent in cash and that now we are denying it.

We always receive it thorough the bank acct.

better initiate eviction proceedings under rent control act - Wilful default. Let him show his bonafide before court
