As per your query I am referring to the Section 17(1)(b) of the Registration Act,1908 which provides documents of which registration is compulsory. In case of equitable mortgage, deposit of title deeds does not require registration, but the crucial question arise is whether the parties intend to reduce the bargain regarding deposit of title deeds to the form of a document. If yes, it requires registration. The Registration Act 1908 is applicable throughout the India.
