Enquiry quashed

In domestic enquiry of bank disciplinary authority came to conclusion that minor penalty of three increments shall meet the ends of justice but on the advice of chief Vigilance Officer of bank major penalty of reduction of grade from MMG-II to JMG-I imposed.

HighCourt has quashed the order of disciplinary authority as well Appellate authority and placed on MMG-II on the date of penalty with consequential benefits.

Now bank has appealed in highcourt for remand of the case for reinquiry from the stage of violation of Regulation.Further appeal filed is lying in default due to non completion of all papers.

What is the best remedy in this matter since litigation will take several years and promotions are affecting.Bank is not implementing court order.

If bank has failed to get the stay on court order they are bound to implement.  Best advise can be given by your advocate who sees the papers.

Mr. Sudhir Kumar has given valuable advice.Kindly follow it and approach your lawyer.

Bank has dumped the matter in safe custody of the court.

 

A time tested trick and tactics to claim court was sleeping on the matter. What can we do?

Knowing your employer fully well and tricks it applies, you could have filed a caveat.

Approach your lawyer.

Check case flow management rules of HC where your case is filed.
