Eligibility for gratuity in chennai jurisdiction

I Have An Uninterrupted Service - 4 Years & 252 Days  (03rd Nov 2008 And  12th July 2013) - The Chennai Organization I Have Worked Was 5-Days-A-Week Working Schedule-However The Said Organization Is Neither Accepting Nor Rejecting My Claim For Gratuity, Though I Was Relieved On Due Notice Period Without Any Adverse Remarks On My Service Record

Please Refer The Files Enclosed Which In My Opinion Clearly States That Any Employee Who Is ‘EMPLOYED FOR 190 DAYS IF HIS ESTABLISHMENT IS WORKING FOR LESS THAN 6 DAYS A WEEK; IN OTHER CASES IF HE IS EMPLOYED FOR 240 DAYS IN A PERIOD OF 12 MONTHS Will Be DEEMED TO Have Served ONE YEAR Period For The Purpose Of Eligibility Of Gratuity’

- PLEASE GUIDE ME

Based on the info posted by you: you are eligible.

Submit FormI as ap by redg. post.

The employer should reply within 1 month or you can approach Controlling Authority of Gratuity.
