Election procedure to co-opted member in hsg.soc.committee

Dear Sir / Madam

Our society have 8 members in managing committee elected 2 years back. Of which 2 members have resigned 6 months back from committee 1 is treasurer and 1 casual member. Chairman and secretary last month Dec'18 appointed internally myself and one more active member as co-opted committee member.

My question - is this the correct procedure to appoint co-opted member in committee as of today. if no then what is the procedure.

pls guide

Thank you

Show the Bye-Laws adopted by your Society to a local lawyer, prima facie there is no legal infirmity in such appointment/ coopting a member.

If the executive committee having power as per Byelaws to nominate such person.  But if any executive post is vacant for any reason, then General Body meeting shall be conducted and the vacancy of such post shall be filled in as per majority as mentioned in the Byelaws.

Managing Committee can co-opt, to fill the vacancy created by the resignations, from the eligible members of the society. Executive posts have to be filled from the rest of the elected members of the managing committee.
