Domestic voilence

Experts ,

 

I got Married 7 yrs Back .. and 6.5 yrs Back My wife left me .  I got Divorce also from her . Maintenance case is pending before the court .  Now my wife filed Domestic Voilence on me .  Is this Petetion Maintainable by the court . do we have any time limitation before which the Case can be filed .  If so pls let me know the Section /Relevant reference cases .

A complaint under the Domestic Violence Act against the husband of a woman can only be entertained when there are living together in a shared household at the time of filing of the complaint. relatives of a woman aggrieved of domestic violence are also absolved of their liability under the Act if they are living separate from the couple.

DV is not maintainable in your case.

It is maintainable but will not hold ground if contested properly.
