Domestic enquiry/ subsistence allowance

Dear Experts,

 

Is the employee under suspension entitled for subsitance allowance i.e. 50% pay, even after being found guilty in the domestic enquiry? In the present case, the employee was suspended in dec 2011 and was order was suspension revoked in April 2013 with enquiry still pending. The employee was allowed to rejoin duty. However, his yearly increments  were held up since 2013. Now the enquiry is completed and he is found guilty of the charges leveled against him in the chargesheet. So if the management decides to still retain the employee by ordering minor punishment, is he entitled for susbsistence allowance and also the difference amount in the salary for the reason his increment being held up ?

What is the punishment order ? if the order mentioned without back wages there is not required to back wage (difference amount of PSA) If order mentioned minor punishment with arrears wage he is eligible.

You are not even describing who is the employer and what are the terms of service providing on this issue.
