The details of the marriage, where and according to which law the marriage solemnised. The foreigner can get marriage dissolved in India provided the marriage was solemnized in India according to any of the Indian matrimonial law applicable to the parties or even outside India which is valid under the Foreign Marriage Act, 1969. The issue of child custody too gets decided by the Family Court keeping in mind the welfare of the minor child. Both parties can settle the issue of child custody and permanent alimony and maintenance etc and move jointly for divorce by mutual consent.
