Deemed conveyance

Dear Experts,

Kindly advise on the following queries, which came up during our CHSL meeting.:

1. Is there any time limit of deemed conveyance - special drive of CM, maharashtra? that is can we approach the department any time from now, for it.?

2. The sinking fund now can be  used without the prior approval of the registrars, with the consent of the members? Is there any limit of its usage percentage or amount wise ? 

3. The sinking fund amount lying with the society, will remain with it after redevelopment.?

4. After procuring deemed conveyance whether the developer / builder remains with any legal rights to challenge the title or stay the redevelopment?

you need to collect all the relevant papers before approaching the authority for conveyance of land in favour of the society. Secondly, after the conveyance of land is done, the builder has no legal right to interfere in it in any manner whatsoever. Thirdly, sinking fund can be used completely when the society is going for redevelopment, subject to permission of the registrar of society. Regards Advocate Rohit Dalmia 9324538481
